J. FREDERICK MOTZ, District Judge.

Ted Figueroa ("Plaintiff") sued Timothy Geithner ("Defendant"), Secretary of the U.S. Department of the Treasury ("Treasury Department"), alleging discrimination in violation of Section 501 of the Rehabilitation Act of 1973. Defendant has filed a Motion for Summary Judgment. For the reasons articulated below, this motion will be denied.
