Plaintiff Richard Hoeft is proceeding in forma pauperis on his claim that defendant Michael Kasten was deliberately in-different to plaintiff's risk of serious harm in violation of plaintiff's Eighth Amendment rights when he refused to transfer plaintiff out of the B side of the segregation unit. Jurisdiction is present. 28 U.S.C. § 1331.
