On Dec. 21, 2007, Plaintiff John Gard, proceeding pro se, filed this action against the U.S. Department of Education and its Secretary, Arne Duncan,1 alleging violations of the Rehabilitation Act of 1973 ("Rehabilitation Act"), 29 U.S.C. § 701 et seq., Title VII of the Civil Rights Act of 1964 ("Title VII"), 42 U.S.C. § 2000e et seq.,
