This is an action to determine priority of invention brought under 35 U.S.C. § 291. Plaintiff Genetics Institute, LLC ("GI" or "plaintiff") filed its complaint on May 16, 2008. In its complaint, plaintiff stated that it owns U.S. Patent No. 4,868, 112 ("the '112 patent"), entitled "Novel procoagulant proteins."
