This matter is before the court on the motion of the defendant, Pikeville Medical Center, Inc., ("Pikeville Medical") to dismiss the claims of the plaintiff, Michael S. Marcum, pursuant to Federal Rule of Civil Procedure 12(b)(6) for failure to state a claim upon which relief may be granted or in the alternative for extension of time in which to answer.
