MEMORANDUM OPINION AND ORDER

PAUL L. FRIEDMAN, District Judge.

This matter is before the Court on the defendant's renewed motion to dismiss the case on the ground that this Court is without jurisdiction to determine whether the defendant breached a settlement agreement between plaintiff and defendant—a determination that defendant maintains must be made before plaintiff may proceed to trial on his underlying Title VII claims.
