On January 6, 2006, the United States Court of Appeals for the Second Circuit held that the defendants in this case, the Xerox Corporation Retirement Income Guarantee Plan and its administrators (hereinafter "defendants" or "the Plan"), violated plaintiffs' rights under the Employee Retirement Income Security Act ("ERISA"), 29 U.S.C. § 1001
