Before the court are Defendant's "Motion for Summary Judgment and Brief in Support" (Dkt. 22), Plaintiff's "Response in Opposition to Defendant's Motion for Summary Judgment" (Dkt. 24), and Defendant's "Reply Brief in Support of Motion for Summary Judgment" (Dkt. 25). For the reasons set out below, Defendant's motion is GRANTED
