OPINION

MYRON H. THOMPSON, District Judge.

Plaintiff Adam Luster filed this lawsuit pursuant to 42 U.S.C. § 1983, asserting that, in the course of arresting him, defendant A.J. Renfroe (a police officer with the Eclectic, Alabama Police Department) used excessive force in violation of the Fourth Amendment. Luster properly invoked the jurisdiction of the court pursuant to 28 U.S.C. § 1331.
