Plaintiff Jean Kelly filed a complaint in this matter on October 3, 2008, seeking damages, a declaratory judgment and injunctive relief against Defendants NovaStar Mortgage, Inc. ("NovaStar"), First Horizon Home Loan Corporation ("First Horizon"), Saxon Mortgage Services, Inc. ("Saxon"), First American Title Insurance Company ("American Title"), and Curran & O'Sullivan.1
