This matter is before the Court on (1) defendant's motion for summary judgment of non-infringement of U.S. Patent No. 7,296,946 (the '946 patent) and (2) plaintiff's motion for partial summary judgment on the issue of infringement of U.S. Patent No. 7,404,685 (the '685 patent).
