This matter is before the Court on the parties' cross motions for summary judgment. After careful consideration of the parties' papers, attached exhibits, and the entire record in the case, the Court will deny plaintiff's motion for summary judgment and will grant defendants' motion for summary judgment in part and deny it in part.1
