In October, 1982, the Commonwealth of Kentucky (the "Commonwealth") opened its case in Jefferson Circuit Court against Petitioner David Matthews on charges of murder and burglary. The jury eventually convicted Matthews on both charges and on November 17, 1982, the trial court imposed the death sentence.
