MEMORANDUM OPINION AND ORDER

INTRODUCTION

This matter is before the Court on separate Motions for Summary Judgment brought by Defendants Dan Mott ("Mott"), Reed Bye ("Bye") and Joan Kunz ("Kunz"). For the reasons set forth below, the Court grants the motion of Defendants Troopers Bye and Kunz, and grants in part and denies in part the motion of Defendant Deputy Mott.
