A jury trial commenced in this case on April 23, 2008. At the close of plaintiff Emile Mazloum's case-in-chief, all defendants moved for judgment as a matter of law. The Court granted the Fed.R.Civ.P. 50(a) motion with respect to the assault and battery claims against Officers Phillips, Modlin, and Schneider but denied all of the other motions.
