United States Court of Appeals, Fifth Circuit.

FILED August 6, 2019.

Attorney(s) appearing for the Case

Terri Lynn Hagan , Assistant U.S. Attorney, Bradley Elliot Visosky , Assistant U.S. Attorney, U.S. Attorney's Office, Eastern District of Texas, Plano, TX, William Richardson Tatum, Esq. , Assistant U.S. Attorney, U.S. Attorney's Office, Eastern District of Texas, Sherman, TX, for Plaintiff-Appellee.

Robert Gerard Arrambide, Esq. , Assistant Federal Public Defender, Federal Defender's Office, Eastern District of Texas, Sherman, TX, for Defendant-Appellant.

Before HIGGINBOTHAM, SMITH, and SOUTHWICK, Circuit Judges.

Manuel Botello-Zepeda appeals the sentence imposed for his conviction of illegal reentry into the United States. He contends that, in imposing an upward variance at sentencing, the district court erred in considering the facts of an unrelated case and his need for treatment for his alcoholism.
