The United States charged Abdullahi Nur with possession of crack with intent to distribute, 21 U.S.C. § 841(a)(1). At the conclusion of his trial, Nur's counsel asked the district court to instruct the jury that, if it did not find Nur guilty of intent to distribute it could still convict Nur of the lesser-included offense...
