Juan Carlos Herrera-Gomez, pro se, seeks leave to file a successive 28 U.S.C. § 2255 motion in the district court presenting claims based on the Supreme Court's recent holding in Peugh v. United States, ___ U.S. ___, 133 S.Ct. 2072, 186 L.Ed.2d 84 (2013), and evidence that is purported to be newly discovered. For the reasons stated below, we deny his motion.
