Porfirio Ortega was convicted by a jury of conspiring to possess with intent to distribute cocaine in violation of 21 U.S.C. § 841(b)(1)(A)(ii) and 21 U.S.C. § 846. The jury found that Ortega conspired to distribute five kilograms or more of cocaine, an amount which Ortega now disputes.
