Fifteen years after his 1990 conviction for aggravated criminal sexual abuse, Jayesh Shah was ordered removed to India. He did not seek judicial review of that order but did file a motion to reconsider and petition for review of its denial. He contended that he should have been granted a waiver of removal under § 212(c) of the Immigration and Nationality Act, 8 U.S.C. § 1182(c) (1994 ed.), as it stood before its repeal in 1996...
