Miguel Lara-Unzueta,1 a native and citizen of Mexico, was convicted of one count of illegal reentry in violation of 8 U.S.C. § 1326(a) and (b)(2). The district court sentenced him to 78 months' imprisonment. Lara appeals, arguing that the district judge erred by failing to disqualify himself from hearing Lara's motion to dismiss the indictment and that this failure requires vacating the conviction and sentence...
