Patrick Davis was charged with four counts of bank robbery and two counts of witness intimidation. A jury convicted him on three of the bank robbery counts, but acquitted him of the other crimes. On appeal, Davis seeks a new trial. He argues that the district court improperly instructed the jury and that the two witness intimidation counts should have been tried before a separate jury under Federal Rules of Criminal Procedure 8(a) and 14(a)...
