A jury convicted Kirk Gutknecht of conspiring to manufacture and distribute 50 grams or more of actual methamphetamine, and possession of pseudoephedrine with intent to manufacture a controlled substance, in violation of 21 U.S.C. §§ 841(a)(1), 841(b)(1)(A), 841(c)(1) and (c)(2), and 846. The district court1 granted Gutknecht a downward variance, sentencing him to the mandatory minimum 120 months in prison...
