A jury convicted David L. Musk on three counts of wire fraud under 18 U.S.C. § 1343. Musk testified at trial. After his brief direct testimony, the government cross-examined him. Musk attempted to invoke his Fifth Amendment rights. The district court1 ruled that the scope of the cross-examination was proper, and thus that Musk waived his rights as to the questioning.
