Donald Lee Peters appeals a judgment of the United States District Court for the District of Puerto Rico, which sentenced him to thirty-three months' imprisonment for failing to register as a sex offender. In calculating a range for his sentence under the sentencing guidelines, the district court included two additional criminal history points because Peters was under a criminal justice sentence when he failed to register.
