In 2006, Plaintiffs-appellees/Cross-appellants Northeast Ohio Coalition for the Homeless ("NEOCH") and Service Employees International Union, Local 1199 ("SEIU") brought an action under 42 U.S.C. § 1983 against then Ohio Secretary of State J.
