Anthony Kimani, a citizen of Kenya, entered the United States in 2000 on a visitor's visa. When that visa expired, Kimani neither left nor sought permission to remain. Three years later he married a citizen of this nation. She applied for a visa on his behalf, and he filed a corresponding request for adjustment of status to that of lawful permanent resident.
