Jeff Pagel brought this action alleging that his employer, TIN Inc., violated the Family and Medical Leave Act (FMLA), 29 U.S.C. § 2601 et seq., by interfering with his right to take leave and retaliating against him for exercising that right. The district court granted summary judgment in favor of TIN, reasoning that the company fired Pagel for poor performance rather than for taking leave.
