In February 2009, Andrew Symonevich was indicted on one count of conspiracy to distribute, and to possess with the intent to distribute, cocaine and heroin in violation of 21 U.S.C. §§ 841(a)(1), 846. He moved to suppress evidence recovered during the search of a car in which he was a passenger. The district court denied Symonevich's motion to suppress.
