After the accidental death of her son, Matthew, Ave Marie Cantrell, along with her husband, Michael, and son, Creighton, filed suit against the City of Murphy and several of its officers. In their complaint, the Cantrells alleged violations of the federal constitution and liability under state common law arising out of the officers' behavior on the day of Matthew's accident.
