Shane McCarthy was convicted in the Milwaukee County Circuit Court of causing great bodily harm by operating a motor vehicle while under the influence of cocaine, in violation of Wis. Stat. § 940.25(1)(am). After unsuccessfully seeking post-conviction relief in Wisconsin state courts, McCarthy filed a petition for writ of habeas corpus in the United States District Court for the Eastern District of Wisconsin.
