Appellant Jermaine Curtis was indicted on May 19, 2009, on two counts of distributing mixtures containing cocaine base in the form of crack cocaine in violation of 21 U.S.C. § 841(a)(1). Curtis agreed to plead guilty on February 22, 2010, to distributing 56.3 grams of a mixture containing cocaine base in the form of crack cocaine.
