Mukash Kumar Maneklal Patel, a citizen of India, entered the United States without inspection in January 1996. The former Immigration and Naturalization Service took him into custody in Texas. On January 14, 1996, Patel was personally served with an Order to Show Cause, which charged him with being deportable pursuant to former Immigration and Nationality Act ("INA") § 241(a)(1)(B) [8 U.S.C. § 1231(a)(1)(B)].
