Gregory Lige appeals his judgment of conviction and sentence for illegal possession of unauthorized access devices, in violation of 18 U.S.C. § 1029(a)(3), which he used to fraudulently obtain cellular phones from Sprint and Nextel. He argues that the district court should have computed the "intended loss" resulting from his scheme using the wholesale price of the phones—that is, Sprint and Nextel's replacement cost...
