The plaintiff, Timothy Shannon, is a former Marine and retired police officer who owns a pub in Sioux City, Iowa, called "Tom Foolery's." In the early morning hours of September 13, 2006, Shannon was arrested inside Tom Foolery's by Michael Koehler, a patrol officer with the Sioux City Police Department.
