Defendant-Appellant John McAllister Hood was convicted after a jury trial of possession with intent to distribute fifty grams or more of actual methamphetamine in violation of 21 U.S.C. § 841(a)(1). Before trial, Mr. Hood had sought to dismiss the indictment against him based on the government's destruction of evidence, but the district court denied his motion.
