U.S. v. WHEATON

No. 09-3171.

610 F.3d 389 (2010)

UNITED STATES of America, Plaintiff-Appellee, v. Vertran M. WHEATON, Defendant-Appellant.

United States Court of Appeals, Seventh Circuit.

Decided June 22, 2010.

Attorney(s) appearing for the Case

Robert N. Trgovich, Attorney (submitted), Office of the United States Attorney, Fort Wayne, IN, for Plaintiff-Appellee.

Daniel T. Hansmeier, Office of the Federal Public Defender, Springfield, IL, Richard H. Parsons, Office of the Federal Public Defender, Peoria, IL, Vertran M. Wheaton, Fort Wayne, IN, for Defendant-Appellant.

Before EASTERBROOK, Chief Judge, and POSNER and WOOD, Circuit Judges.

POSNER, Circuit Judge.

The defendant's supervised release was revoked because he admitted having violated its terms by helping to distribute marijuana; by way of sanction the judge ordered him to serve 36 months in prison. The defendant appealed. His lawyer has filed an Anders brief in which he reviews the grounds for an appeal and concludes convincingly that all would be frivolous. See Anders v. California, 386 U.S. 738
