This is the third time we consider David England's appeal of his sentence from his January 6, 2006 conviction. In 2006, England was convicted of possession of a firearm as a felon in violation of 18 U.S.C. § 922(g)(1) (Count I), attempting to persuade a witness to provide a false alibi for him in violation of 18 U.S.C. § 1512(b)(1) (Count II), attempting to cause a witness to conceal evidence in violation of 18
