Eddie Powell was convicted of capital murder on June 16, 1998. In accordance with the 11-1 jury recommendation, on August 27, 1998, the trial judge sentenced him to death.1 Powell appealed his conviction and sentence to Alabama's criminal appellate court and, when both were affirmed, Powell v.
