The Government indicted Timothy Lee York (York) on three counts: arson in violation of 18 U.S.C. § 844(f)(1) (count one); carrying a destructive device in relation to a crime of violence contrary to 18 U.S.C. § 924(c)(1)(b) (count two); and possession of a firearm not registered in the National Firearms Registration and Transfer Record in violation of 26 U.S.C. § 5861(d) (count three).
