PER CURIAM.

Appellant Nina Shahin, a pro se litigant, seeks review of the District Court's February 26, 2009 Order granting Defendants', the State of Delaware and the State of Delaware Department of Transportation (together "the State,") motion to dismiss under Rule 37(b) of the Federal Rules of Civil Procedure. For the reasons set forth below, we will affirm.
