Facing removal proceedings, Emmanuel Obi, a native of Nigeria, applied for cancellation of removal. The immigration judge concluded that because Obi had been convicted of marriage fraud in 1996, he was ineligible for relief under IIRIRA, which did not take effect until 1997.
