The Equal Employment Opportunity Commission ("EEOC") brought this suit against the University of Louisiana at Monroe ("ULM")1 for alleged violations of the Age Discrimination in Employment Act ("ADEA"). ULM moved to dismiss on Eleventh Amendment immunity grounds, and the district court denied the motion. ULM now brings this interlocutory appeal under the collateral order doctrine.
