U.S. v. DIAZ

No. 06-13782.

540 F.3d 1316 (2008)

UNITED STATES of America, Plaintiff-Appellee, v. Michael A. DIAZ, Defendant-Appellant.

United States Court of Appeals, Eleventh Circuit.

August 22, 2008.

Attorney(s) appearing for the Case

Lynn Gitlin Fant (Court-Appointed), Waco, GA, for Diaz.

Zahra S. Karinshak, Amy Levin Weil, U.S. Atty., Atlanta, GA, for U.S.

Before BIRCH, CARNES and COX Circuit Judges.

PER CURIAM:

Michael A. Diaz ("Diaz") appeals his convictions for armed bank robbery, use of a firearm during a crime of violence, and possession of a firearm by a convicted felon. On appeal, Diaz argues that his waivers of his rights to counsel and to a jury were not knowing and voluntary. After reviewing the record and the parties' briefs, and with the benefit of oral argument, we conclude that Diaz did not knowingly waive his right to a jury trial.
