SHELDON, J.

The petitioner, Jose Guerra, appeals from the judgment of the habeas court dismissing his petition for a writ of habeas corpus for lack of subject matter jurisdiction on the ground that he was no longer in custody pursuant to his challenged judgment of conviction at the time he filed his petition. For the following reasons, we disagree, and thus affirm the judgment of the habeas court.
