The issue before this court is the scope of an employer's duty for the tortious conduct of an employee, outside the scope of his employment, that occurred off the employer's premises. The plaintiff, Janine Cannizzaro, commenced this action after she was injured in an automobile accident with the defendant Stephan Marinyak. At the time of the accident, Marinyak was an employee of the defendant Diane Jennings Mayo, a homeowner in Redding.
