The defendant, Edward Jevarjian, appeals from the judgment of the Appellate Court, which affirmed the trial court's judgment of conviction following the defendant's conditional plea of nolo contendere to the charge of possession of marijuana with intent to sell by a person who is not drug-dependent. See General Statutes § 21a-278 (b).1 The defendant's plea was conditioned, pursuant to General Statutes § 54-94a,
