GRUENDEL, J.

The petitioner, Arthur J. Davis, appeals following the habeas court's grant of summary judgment in favor of the respondent, the commissioner of correction. On appeal, the petitioner argues that the court improperly concluded that he was not entitled to be resentenced in accordance with General Statutes § 53a-35.1 We affirm the judgment of the habeas court.
