The defendant, the commissioner of public safety,1 appeals from the summary judgment rendered by the trial court partially in favor of the plaintiff, Ricky A. McCoy, declaring illegal the defendant's designation of the plaintiff as a "convicted felon" and permanently enjoining the defendant from designating any person a convicted felon because of a second conviction within ten years under General Statutes § 14-227a,
