Modification of opinion (229 Cal.App.4th 1291; ___ Cal.Rptr.3d ___), upon denial of rehearing.

THE COURT. — IT IS ORDERED that the opinion filed September 22, 2014, be modified as follows and the petition for rehearing is DENTED.

On page 20, in the second sentence of the Disposition [229 Cal.App.4th 1309, advance report, 1st par., line 5] beginning with "The superior court is directed" delete "without leave to amend" so the sentence reads:

The superior court is directed to vacate the portion of its October 3, 2012 order which overruled...
